In these Booking Terms & Conditions:
– ‘We’, ‘us’ or ‘our’ means Kerridge Properties Ltd, trading as Herongate Apartments; and
– ‘You’ or ‘your’ means the person or legal entity making the booking with us.
By making a booking with us you agree to comply with and be bound by these Booking Terms & Conditions.
A contract between you and us will come into existence when payment is received and a booking confirmation is issued showing the confirmed holiday dates. The contract binds you and all the members of your party. It is your responsibility to ensure that all members of your party accept the terms of the contract set out in these Booking Terms & Conditions. Failure to disclose all relevant information or comply with these Terms & Conditions may lead to termination of the contract and loss of the booking.
Bookings made via an online travel agent may be subject to different terms and conditions. If you booked via an online travel agent, please also refer to the booking terms and conditions provided by your online travel agent.
GUEST ELIGIBILITY
You must be at least 18 years old to make a booking, unless you are accompanied by an adult.
You must be able to provide photographic identification (for example, a passport or drivers licence), upon arrival at the property.
It is your responsibility to ensure that we have up-to-date contact details for you up to the later of your check out date or the date on which all outstanding payment is received by us.
CHILDREN
No matter how much care is taken, the property is not childproof.
Children are allowed in the property so long as they are accompanied by an adult who takes full responsibility for their safety and security all times. Children must never be left without adult supervision.
MAXIMUM STAY AND OCCUPANCY
We regret that we cannot welcome you for more than 3 months at any one time.
Goldfinch and Woodpecker have a maximum occupancy of 4 persons. Robin and Kingfisher have a maximum occupancy of 2 persons. We do make exceptions, however, for small infants in a travel cot. We have the right to refuse any booking, either in advance or at time of check in, if the property you have booked is going to be over-occupied. We also reserve the right to terminate the booking without notice and without refund in case of over-occupation.
DEPOSIT
In order to secure a booking with us you must pay a deposit.
If the booking is made more than 2 weeks prior to your check in date, we will collect
a 30% deposit.
If the booking is made less than 2 weeks prior to your check in date, we will collect a
100% deposit.
Please note that if you have booked through online travel agent the deposit policy may be different and it is the relevant online travel agent’s policy that will prevail.
CANCELLATIONS
All cancellations must be notified in writing.
If you have booked through our website (herongateservicedapartments.com) and you cancel your booking before 22:00 28 days before check-in, cancellation is free of charge. If you cancel your booking between 28 days and 14 days before check-in, we will charge you 30% of the total payment. If you cancel less than 14 days before check-in, we will charge you 100% of the total payment.
Where you have purchased booking extras (for example, a Welcome Pack) and then cancel these prior to your stay we will endeavour to provide you with a refund unless we have already incurred costs that we cannot recover (for example, if we have already purchased perishable goods for you that cannot be reused for another guest within a reasonable time).
Please note especially that if you have booked through online travel agent the cancellation policy may be different and it is the relevant online travel agent’s policy that will prevail.
We strongly advise that you take out comprehensive travel insurance to cover cancellations. We will not be responsible for any loss that you may incur due to your cancellation.
COVID-19 CANCELLATIONS
Provided that Herongate Apartments is “open for business” and can fulfil its contractual obligations, then we do not accept any liability or responsibility and will not issue refunds or pay compensation in the event of you:
– Cancelling your holiday or deciding not to travel, including disinclination to travel, due to Covid-19.
– Showing symptoms and self-isolating before travelling due to Covid-19.
– Being unable to travel because of restrictions imposed on you by your government or relevant health authorities due to Covid-19.
RATES
Rates include VAT (where applicable) and are payable in pounds sterling (£)(GBP). Rates are subject to change at any time. Rates may vary depending on the property, the number of guests, dates, and duration of stay.
If you have booked an apartment for less than 28 days, your rate will include a weekly clean and linen change. If you have booked for 28 days or longer, cleaning and linen charges are deemed extras. You will need to request these and you will be charged for them in accordance with the amount of times you request cleaning/a linen change.
All utility bills, including council tax, electricity, water, television licence, and Internet access, are included in the quoted rate. Food and drink is not included in the quoted rate (although you may request a Welcome Pack for an extra charge).
CHARGES
Please note that there is a one-time £30 sofa bed charge for the provision of linen for sofa beds.
If you are staying for 28+ days you can request cleaning for £30 per instance and a linen change for £20 per instance. You may request dry cleaning or ironing services, for which you will be charged separately.
Pets are welcome, but a £20 charge applies for each pet, up to a maximum of two pets. Please let us know if your pet is assisting you with difficulties, in which case we will accommodate your pet free of charge. You will be invoiced for any damage caused by your pet. Additional cleaning requirements that we reasonably consider are in excess of the usual cleaning requirements at the end of a guest’s stay, such as
excessive hair/fur on furniture or fabrics, will incur an additional charge. For the safety and comfort of all guests, please ensure pets are kept under proper control and are not left unattended.
You can request a Welcome Pack, which will be made available to you on the day you check in. We charge £30 for a Welcome Pack, which normally includes: 40 tea bags, 100g of coffee, one pint of milk, sugar, spreadable butter, a loaf of bread, cheese, four slices of ham, six eggs, a bottle of wine, and a 1.5 litre bottle of water.
CLEANLINESS
You are responsible for the condition of the property and the furniture and fittings therein. All properties are cleaned thoroughly between guests; however, you must leave the property in the same state of cleanliness and general order in which it was found. We reserve the right to charge a cleaning fee for properties that are not left in a reasonable state of cleanliness.
FURNITURE AND FITTINGS
All furniture and fittings must remain in the property and not be taken to another property. We have a full inventory of the items in the apartments should you wish to view it.
NO SMOKING/RECREATIONAL DRUG USE
All the property is ‘no smoking’ and we kindly ask that you and any of your guests respect this for the comfort and safety of all our guests and staff. It is an offence to smoke in a non-smoking establishment and anyone doing so may be liable for a fine. Additionally, if you or your guests are found to have smoked in any of the apartments or shared areas, we reserve the right to charge you £100 per instance.
The use of recreational drugs is also strictly prohibited anywhere on our premises. Your booking may be cancelled without refund, and you and any of your guests may be asked to leave the property, if you or any of your guests fail to comply with this condition. We may also charge an additional cleaning fee if necessary.
PARKING
Parking is located onsite and free of charge. Vehicles and belongings are left at the owner’s risk and we cannot be held responsible for loss of or damage to said vehicles and or any personal belongings held inside or in the vicinity of said vehicles.
If you would like to reserve a parking spot prior to your arrival, including the electric car charging point, kindly inform us of the same and we will endeavour to reserve a parking spot for your use.
CHECK IN/OUT
Check in is between 15:00-22:00 but remote check-in is possible. Check out is at 11:00. This allows the accommodation to be thoroughly cleaned and prepared for incoming guests. Late check out that has not been agreed to beforehand will incur a charge. We may be able to arrange a late check out subject to availability, and there may be a one-off charge. Remote check out is possible.
If you arrive late, or depart early, this is at your sole discretion and you will not be provided with a refund of any payments made to us.
If check in is specified in your booking confirmation email and is different from the above, the check in times in your booking confirmation will prevail.
KEY CARD
You will be provided with a key card with which to access the property. If damaged or lost, you will be charged for it to be replaced.
HERONGATE CLUB
All adult guests (16 or over) at Herongate Apartments benefit from free access to Herongate Club during the Club's opening hours. This includes use of the gym and access to the pool, although spaces must be reserved (a Covid-19 safety measure). Adult guests may attend classes for a small fee and subject to availability, and may also make use of the sunroom (also subject to a small fee and availability).
HONESTY CAFE
All guests at Herongate Apartments may be eligible for a discount at Honesty Café, located inside Herongate Club. Please let staff know you are a Herongate Apartments guest to benefit from available discounts.
Please note that Honesty Café is independent of Herongate Apartments.
LIABILITY
Other than for death or personal injury caused by our negligence or fraudulent misrepresentation, our total liability to you is limited to the price of the booking and in no circumstances will we be responsible to you for any indirect or special damages.
We will not be liable for failure to provide the services to the extent that the failure
is caused by any factor beyond our reasonable control.
We will not be liable for the loss of or damage to personal belongings or valuables. You should therefore organise your own insurance against such cases.
We will not be liable for any temporary defect or malfunction of any equipment, machinery, or appliance in the property, building, or surrounding grounds, although we will endeavour to fix the equipment and machinery to ensure your convenience.
We will not be liable for any temporary outage of electricity, gas, water, Internet connection, or television service.
You are responsible for any damage or loss caused to us by your act, omission, or neglect, or that of any of your guests or pets, and you agree to indemnify us and pay us on demand the amount reasonably required to make good or remedy any such damage or loss. You will also be responsible for an amount equivalent to the amount payable for the property for any time period for which it is considered unusable due to damage.
If you notice something is missing or damaged in the property, please let us know immediately so that we can take appropriate action. If there has been any damage or during your stay, we would be grateful if you could report this promptly. The accommodation will be inspected at the end of your stay. If items are found to be missing or damage is discovered after you depart, you will be notified of any charges in writing, email or phone, within a reasonable amount of time.
RESPECTING THE COMMUNITY
Please respect the community and try to keep noise levels to a minimum, especially between 23:00 and 7:00.
We reserve the right to terminate your booking immediately without being liable for any refund or compensation if you, or any of your guests, engage in unacceptable or unreasonable behaviour that causes a disturbance or nuisance to, or otherwise impairs the enjoyment, comfort, or health of others.
MAINTENANCE AND INSPECTION
We, or our representatives, reserve the right to enter the property at any time to undertake essential maintenance or for inspection purposes.
NO RE-LET/SUBLET
You may not re-let or sublet the property, even free of charge.
DATA PROTECTION
We will process the information you provide to us in accordance with the relevant data protection legislation. Your personal data may be transferred to Eviivo Limited (Registered Office: 154 Pentonville Road, London, N1 9JE; Company No.: 5002392), including, where necessary, to its subsidiaries outside of the European Union. By making a booking, you consent to this processing of information as described above and the transfer of your information to our software provider: Eviivo Limited.
LAW
The laws of England and Wales will apply to these Booking Terms & Conditions.
